Terms and conditions

These terms cover your use of pophasta.com and any work you ask us to do. The written scope for your project sets out its details, and these terms apply alongside it.

Who we are

Pop Hasta is a sole proprietorship based in India. We design and build custom software, websites and integrations, and look after them once they are live. In these terms, “we” and “us” mean Pop Hasta, and “you” means the person or business using our website or our services. Our contact details are at the end of this page.

Using this website

You’re welcome to browse pophasta.com and click through our demos. The demos run on example data and are there to show what we build.

  • Don’t try to break, overload or get into any part of the website or its servers.
  • Don’t copy our content, designs or demos to offer as your own.
  • Please don’t send passwords, card numbers or health details through our contact form.

We work to keep the website available and accurate, but we can’t promise it will always be free of interruptions or errors. Nothing on it is an offer until we confirm it in writing.

How a project works

Every project starts with a scoping call. Afterwards we send you a written scope that sets out what we’ll build, the timeline, the price and how the payments are split. Work starts when you accept the scope in writing (an email is enough) and make any first payment it asks for.

If you want something that isn’t in the scope, we’ll agree the change, its cost and its effect on the timeline in writing before we do it. Where your scope and these terms say different things, the scope applies to that project.

Prices and payment

Our prices are set in each scope or quote, in the currency it states. A quote is valid for 30 days unless it says otherwise. Taxes such as GST are added where the law requires them.

A project is usually paid in parts: a scoping fee, payments tied to the stages in your scope and, if you choose one, a yearly support plan. Invoices are due within 14 days unless your scope says otherwise. You can pay by bank transfer or through the payment services we offer at the time, such as PayPal, whose own terms also apply to the payment.

If a payment is late, we may pause work until it’s made, and we’ll tell you before we do.

Delivery

We don’t ship physical goods. Everything we make is delivered online: you get a working demo every fortnight while we build, and the finished system is handed over or set live on the date agreed in your scope. Timelines depend on getting your feedback, content and access on time, and we’ll tell you as soon as we see a date moving.

What we need from you

To deliver on time, we need accurate information, the access we ask for, and your feedback within the times agreed in the scope. You’re responsible for the content and data you put into your system, and for having the right to use it, including any consent needed from the people it is about.

Who owns what

Once you’ve paid for a project in full, you own the code, designs and content we created specifically for you in it.

We keep ownership of the tools, components and know-how we had before your project or use for many clients, and we give you a permanent licence to use them as part of your system. Open-source components stay under their own licences, and products from Pop Hasta Labs, such as SCRS, are provided under their own terms.

We won’t name you as a client or show your system to anyone without your permission.

Confidentiality and your data

We each keep the other’s confidential information private and use it only for the project. When we handle personal data inside your system, we act only on your instructions and protect it as described in our privacy notice. We can sign a data processing agreement if you need one.

Fixing problems

If something we built doesn’t work as described in the scope, tell us within 30 days of it going live and we’ll fix it at no charge. After that, fixes and changes are covered by your support plan, or quoted separately if you don’t have one.

Our responsibility to you

We do our work with reasonable skill and care. Our total liability for any claim connected with a project is limited to what you paid us for that project in the 12 months before the claim. We aren’t responsible for indirect losses, such as lost profits, data you didn’t back up, or problems caused by services run by other companies. Nothing in these terms limits any liability the law doesn’t allow us to limit.

Cancelling and refunds

You can cancel a project or a support plan at any time. What you pay and what we refund is set out in our refund and cancellation policy.

Either of us can end an agreement straight away if the other seriously breaks it and doesn’t put it right within 14 days of being told. When an agreement ends, you pay for the work done up to that date, and we hand over the work you’ve paid for.

Changes to these terms

We may update these terms from time to time; the date at the top shows the latest version. A project you’ve already agreed stays under the terms in force when you accepted its scope, unless we both agree otherwise in writing.

Law and disputes

These terms are governed by the laws of India. If a disagreement comes up, we’ll first try to settle it by talking. If we can’t, the courts at Jaipur, Rajasthan, have exclusive jurisdiction.
